Welcome to PleinScout. These Terms of Use ("Terms") are an agreement between you and PleinScout LLC, a California limited liability company ("PleinScout," "we," "us," or "our"), covering your use of the PleinScout website, app, and related services (together, the "Service"). Please read them carefully.
By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Beta service
PleinScout is currently offered as a beta. That means the Service is still in development and may change, break, or go offline without notice. Features may be added, removed, or altered at any time. Information in the Service, including location details, may be incomplete or inaccurate. We provide the beta "as is" and do not promise it will always work as intended.
2. Who can use PleinScout
You must be at least 18 years old to use the Service. By using PleinScout, you confirm that you are 18 or older and that you are able to enter into this agreement. The Service is not directed to children, and we do not knowingly collect information from anyone under 18.
3. Your account
To use most features, you create an account. You agree to provide accurate information, keep your login details secure, and let us know if you suspect any unauthorized use of your account. You are responsible for activity that happens under your account. We may suspend or close accounts that violate these Terms or our Community Guidelines.
4. Outdoor safety and your own judgment
This part matters more for PleinScout than for most apps, so please read it closely.
PleinScout helps you find outdoor locations to paint and sketch. We do not own, control, inspect, or guarantee any of these locations. Conditions in the field change constantly. Weather, terrain, wildlife, traffic, tides, trespassing boundaries, crime, and access rules are outside our control and may not match what the app shows.
You are solely responsible for your own safety and decisions when you visit any location. Always use your own judgment. Check current conditions, confirm that a location is open to the public and that you have permission to be there, respect private property, follow all local laws and posted rules, and leave if a place does not feel safe. Locations listed in PleinScout are suggestions shared by us or other users, not endorsements or guarantees of safety, legality, or access.
5. User content
PleinScout lets you post content, such as artwork images, location notes, reviews, spot recommendations, comments, and profile information ("User Content").
You keep ownership of your User Content. By posting it, you grant PleinScout a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and share that content for the purpose of operating, promoting, and improving the Service. For example, this lets us show your saved spot notes to other painters or feature posted artwork within the app. This license ends when you delete your User Content or close your account, except for copies retained in routine backups or where others have already shared it.
You are responsible for your User Content. By posting it, you confirm that you created it or have the right to share it, that it does not infringe anyone else's rights, and that it follows our Community Guidelines. You must not post content that is unlawful, harmful, harassing, hateful, deceptive, or that reveals private locations, private property, or another person's information without permission.
We are not obligated to monitor User Content, but we may review, remove, or restrict any content that we believe violates these Terms or our Community Guidelines, at our discretion.
6. Sharing locations responsibly
Locations are the heart of PleinScout, and they come with responsibility. When you add or describe a spot, do not share access to private property you do not own or have permission to share, do not post sensitive or protected sites, and do not encourage trespassing or unsafe behavior. We may remove location content that creates safety, legal, or privacy concerns.
7. Acceptable use
When using PleinScout, you agree not to:
- break any law or encourage others to;
- harass, threaten, or harm other users;
- post false, misleading, or spam content;
- scrape, copy, or harvest data from the Service except as expressly allowed;
- interfere with, overload, or attempt to breach the security of the Service;
- use the Service to advertise or sell without our permission;
- impersonate anyone or misrepresent your connection to a person or place.
8. Our content and intellectual property
The PleinScout name, logo, app, design, and original content are owned by PleinScout LLC and protected by intellectual property laws. We grant you a limited, personal, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, or create derivative works from the Service itself without our written permission.
9. Third-party services and links
PleinScout may use or link to third-party services, such as maps, weather data, or event listings. We do not control those services and are not responsible for their content or accuracy. Your use of them may be governed by their own terms.
10. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not warrant that the Service will be accurate, reliable, uninterrupted, secure, or free of errors. We do not warrant the accuracy, safety, legality, or accessibility of any location, event, or User Content. To the fullest extent permitted by law, we disclaim all warranties.
11. Limitation of liability
To the fullest extent permitted by law, PleinScout LLC and its members, managers, employees, contributors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any injury, loss, or harm arising from your use of the Service or from visiting any location found through the Service. This includes harm to person or property in the field. Your use of PleinScout and any painting location is at your own risk.
Where liability cannot be excluded by law, our total liability to you is limited to the amount you paid us, if any, in the twelve months before the claim.
12. Indemnity
You agree to defend and hold harmless PleinScout from claims, losses, and expenses arising from your use of the Service, your User Content, your visits to locations, or your violation of these Terms or the rights of others.
13. Changes to these Terms
We may update these Terms as PleinScout grows. If we make material changes, we will update the date above and, where appropriate, notify you in the app or by email. Continuing to use the Service after changes take effect means you accept the updated Terms.
14. Ending your use
You may stop using PleinScout and close your account at any time. We may suspend or end your access if you violate these Terms, with or without notice. Sections that by their nature should survive, such as user content licenses already granted, disclaimers, and liability limits, will continue to apply.
15. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute will be handled in the courts located in San Diego County, California, unless the law requires otherwise.
